Food & Beverage Kratom Ban
NM Environment Dept declared kratom an unapproved food ingredient — banning it from all permitted food establishments statewide. Enforcement active. NMKA position: OPPOSE without KCPA alternative. Action needed: Submit public comment to NMED.

KCPA Adoption — 2027 Priority
18 states have enacted the Kratom Consumer Protection Act. New Mexico has not. NMKA is briefing incoming legislators and building the constituent record for KCPA introduction in the 2027 session.
Full NM legal statusAlbuquerque Kratom Retail Ban — Active
In October 2025, the City of Albuquerque Environmental Health Department began full enforcement of a kratom retail ban. Over 50 stores were visited and more than 5,400 products were embargoed. Fines range from $250 to $1,000 per offense.
The ban applies to retail store sales only. Personal possession and online orders remain legal. Santa Fe and other NM cities have not followed with restrictions.

NM Statewide: Kratom Banned in Food and Beverages
The New Mexico Environment Department prohibits kratom in all food and beverage products sold at permitted facilities statewide — including shots, liquids, gummies, drink mixes, and vapes. Kratom in powder and capsule form remains legal.

Federal Threat: Senate Letter to FDA — March 2026
In March 2026, a group of U.S. Senators sent a letter to the FDA urging federal scheduling of kratom. This is the most significant federal threat since the DEA’s 2016 scheduling attempt, which was withdrawn after public opposition. The American Kratom Association is mobilizing national advocacy in response.

Monitor
NMKA tracks every introduced bill for kratom-related language. We review full text, sponsor history, and committee assignment within 24 hours of introduction. Members receive initial brief by email.
Mobilize
When a bill moves to committee hearing, NMKA activates the relevant district teams. Email campaigns, phone banking scripts, and testimony templates are distributed within 48 hours of hearing notice.
Report
After every vote, hearing, or amendment, NMKA publishes a rapid update to all members with outcome, next steps, and score impact for relevant lawmakers. Accountability documented in public record.

NMED Action — Restrictive amendment package
The current NMED Action amendment would add language defining kratom as a "controlled substance analog" in retail licensing law — a backdoor functional ban that bypasses the full legislature.
NMED Food Ban — KCPA safeguards gaining support
NMED Food Ban's consumer protection provisions are gaining committee support following NMKA's March 12 testimony push. Two previously uncommitted senators have publicly indicated support. Constituent email volume this week is critical to maintaining momentum through Friday's hearing.
