Volunteer Testimony Impact Report

New Mexico Kratom Advocates coordinated a consumer testimony campaign in response to the NMED food and beverage kratom ban announcement. This report documents the results.

Campaign Overview

Following the NMED announcement prohibiting kratom in food and beverage products, NMKA organized a coordinated consumer response asking New Mexicans to submit written public comments to the NM Environment Department and to the NMDOJ Consumer Protection Bureau.

Results

  • 120+ written consumer comments submitted to NMED and NMDOJ
  • 32 counties represented in submissions
  • Comments documented responsible consumer use, economic impact on small retailers, and requests for KCPA adoption as an alternative framework
  • 14 business owners submitted separate impact statements about inventory losses from enforcement actions

Key Themes From Testimony

Responsible adult use: The majority of submitters described years of responsible kratom use for pain management, energy, focus, and opioid recovery support — without adverse effects.

Small business impact: Several Albuquerque and Alamogordo retailers documented significant inventory losses from NMED and EHD enforcement without advance notice or a product transition period.

KCPA support: 87% of submissions explicitly supported KCPA adoption as the preferred alternative to prohibition-style enforcement.
